If this is not done, the awarding chamber may, in the event of a review procedure, assume that the bidder has consented to the inspection of its documents (Section 165 (3) GWB). When initiating a review procedure, GSI as the awarding authority is obliged to make the award files available to the awarding chamber immediately (Section 163 (2) sentence 3 GWB). Candidates / bidders have a claim against the contracting authority to compliance with the bidder-protecting provisions on the award procedure (Section 97 (6) GWB). If a candidate / bidder interested in the contract believes that its rights have been violated due to non-compliance with procurement regulations, the violation must be reported to GSI within ten calendar days (Section 160 (3) sentence 1 no. 1 GWB). Violations that are recognisable on the basis of the contract notice or the award documents must be notified to GSI no later than the deadline for submission of applications (or tenders) specified in the contract notice (Section 160 (3) sentence 1 no. 2 - 3 GWB). If GSI informs the applicant / bidder that it does not wish to remedy its complaint, it has the option of filing an application for review with the above-mentioned procurement chamber within 15 days of receipt of the notification (Section 160 (3) sentence 1 no. 4 GWB). Bidders whose tenders are not to be considered for the award of the contract will be informed of this prior to the award of the contract in accordance with Section 134 GWB. A contract may only be concluded 15 calendar days after this information has been sent by GSI. In the case of transmission by fax or electronically, this period shall be ten calendar days. It begins on the day after the information is sent by GSI. After expiry of this period, a contract award is possible even if a period pursuant to Section 160 (3) GWB has not yet expired. An application for review would therefore have to have been served on GSI by the procurement chamber before the deadline under Section 134 GWB expires in order to prevent an award. Pursuant to Section 135 (1) and (2) GWB, the invalidity of a contract award can only be established if it has been asserted in the review procedure within 30 calendar days of notification of the conclusion of the contract, but no later than six months after conclusion of the contract. If the contracting authority has published the award notice in the Official Journal of the European Union, the period for asserting invalidity ends 30 calendar days after publication of the award notice in the Official Journal of the European Union. ? Candidates' attention is drawn to the legal significance of Section 160 (3) GWB, (3) GWB, in particular No. 4 thereof: (1) The procurement chamber shall initiate a review procedure only upon application. (2) Any company that has an interest in the public contract or concession and asserts an infringement of its rights pursuant to Section 97 (6) due to non-compliance with procurement regulations is authorised to file an application. It must be shown that the company has suffered or is at risk of suffering damage as a result of the alleged breach of the procurement regulations. (3) The application is inadmissible if 1. the applicant has recognised the alleged breach of procurement regulations before submitting the application for review and has not notified the contracting authority within a period of ten calendar days; the expiry of the period pursuant to Section 134 (2) remains unaffected, 2. infringements of procurement regulations which are recognisable on the basis of the con …
